Menteco Terms of Service

1. Agreement

These Terms of Service ("Terms") are a binding agreement between Menteco Private Limited ("Menteco," "we," "us") and the person or organization using the Menteco platform ("you"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy, which is incorporated by reference.

Students under 18: your use of the Service is additionally governed by the Student Terms & Consent Notice, and requires the consent described in Section 4.

2. The Service

Menteco provides a college counseling and mentorship platform, including mentor and student applications, communication and scheduling tools, goal and application tracking, document sharing, and AI-assisted features such as daily briefings and reminders ("Service").

3. Accounts and Eligibility

  • Mentors must be at least 18 and must provide accurate account and organization information.

  • Students must be at least 13. Students aged 13–17 require consent as described in Section 4. The Service is not available to children under 13.

  • You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately of any unauthorized use at support@menteco.co.

4. Mentor Responsibilities for Student Accounts

Students join Menteco by invitation from a Mentor. By inviting a student, you (the Mentor) represent and warrant that:

  1. The student is at least 13 years old;

  2. For students aged 13–17, you have obtained — or your school or organization holds — verifiable consent from the student's parent or legal guardian, or your school has authority to consent on the parent's behalf under applicable law (including FERPA's school-official framework);

  3. You will maintain records of such consent and provide them to Menteco upon reasonable request;

  4. You will use student data only for legitimate counseling and mentorship purposes.

You are responsible for the accuracy of these representations. Menteco may suspend student accounts if we have reason to believe required consent is missing.

5. Subscriptions, Billing, and Payment

Plans. The Service is offered on a Free plan and paid subscription plans (currently Pro and Firm), with features and student limits described at the time of purchase. We may change plan features or pricing prospectively with at least 30 days' notice; changes do not affect a current billing period.

Billing. Paid subscriptions are billed in advance on a recurring basis (monthly or annually) through Stripe, our payment processor. By subscribing, you authorize recurring charges to your payment method until you cancel.

Promotional pricing. Promotional offers (such as founding-member pricing) apply for the period stated in the offer. Unless the offer states otherwise, the subscription renews at the then-current standard price after the promotional period ends. Promotional terms are limited in quantity and time and may be withdrawn for new customers at any time.

Cancellation. You may cancel at any time from your account settings. Cancellation takes effect at the end of the current billing period; you retain access until then.

Refunds. Except where required by law, payments are non-refundable and we do not provide refunds or credits for partial billing periods. If we materially fail to provide the Service, contact billing@menteco.co and we will work with you in good faith.

Taxes. Prices exclude applicable taxes, which are calculated and collected at checkout where required.

Non-payment. If a renewal payment fails, we will retry and notify you. Continued non-payment may result in downgrade to the Free plan or suspension. Your data is handled per the retention terms in the Privacy Policy.

6. Your Data

You own your data. Mentors own the business data they enter; students (and their parents, for minors) retain all rights in student data. You grant Menteco a limited license to host, process, transmit, and display this data solely to provide and secure the Service, as described in the Privacy Policy.

Student data commitments. Menteco does not sell personal data, does not use student data for advertising, and does not use your data to train AI models. See the Privacy Policy for full details, including data location (United States), retention, and deletion.

Export. You may export your data at any time while your account is active, and for 90 days after a paid subscription ends.

7. AI Features

The Service includes AI-generated content such as briefings, summaries, and reminders. You acknowledge that:

  • AI outputs are informational assistance only and may contain errors or omissions;

  • AI outputs are not professional, legal, financial, or admissions advice, and do not guarantee any admissions outcome;

  • Critical information — especially application deadlines, requirements, and school-specific policies — must be independently verified;

  • Mentors remain solely responsible for the counseling advice they provide to students.

8. Acceptable Use

You agree not to:

  • Access data of students, mentors, or organizations you are not authorized to access, or probe or circumvent access controls;

  • Use the Service to harass, exploit, or harm any person, or to communicate with a student for any purpose outside legitimate counseling and mentorship;

  • Upload unlawful, infringing, or malicious content;

  • Scrape, resell, or sublicense the Service, or use it to build a competing product;

  • Interfere with the integrity or performance of the Service;

  • Misrepresent consent or eligibility under Section 4.

We may suspend or terminate accounts that violate this section. Suspected harm to a minor will be escalated and, where appropriate, reported to authorities.

9. Intellectual Property

Menteco and its licensors own the Service, including software, design, and branding. These Terms grant no rights in the Service except the limited right to use it per these Terms. Feedback you provide may be used by Menteco without obligation.

10. Confidentiality

Each party will protect the other's non-public information with reasonable care and use it only as needed to perform under these Terms.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, MENTECO DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. MENTECO DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANY EDUCATIONAL OR ADMISSIONS OUTCOME WILL BE ACHIEVED.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW: (a) NEITHER PARTY IS LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS OR DATA; AND (b) MENTECO'S TOTAL LIABILITY ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID TO MENTECO IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY (OR $100 IF YOU ARE ON A FREE PLAN).

Nothing in these Terms limits liability that cannot be limited by law, including liability arising from gross negligence, willful misconduct, or violations of children's privacy laws.

13. Indemnification

Mentors will indemnify Menteco against third-party claims arising from (a) breach of the consent representations in Section 4, or (b) the Mentor's counseling services or advice provided to students.

14. Term, Termination, and Data

These Terms apply while you use the Service. You may stop using the Service and delete your account at any time. We may suspend or terminate your access for material breach of these Terms, with notice where practicable. Upon termination, data export and deletion are handled per the Privacy Policy (90-day export window for ended paid subscriptions; deletion on request).

15. Changes to the Service or Terms

We may modify the Service or these Terms. For material changes to these Terms, we will provide at least 30 days' notice by email or in-app notice. Continued use after the effective date constitutes acceptance; if you do not agree, cancel before the change takes effect.

16. Governing Law and Disputes

These Terms are governed by the laws of the State of [Delaware / state of incorporation], without regard to conflict-of-laws rules. The parties will first attempt to resolve any dispute informally by contacting legal@menteco.co. 17. General

These Terms and the Privacy Policy are the entire agreement between you and Menteco regarding the Service. If any provision is unenforceable, the remainder stays in effect. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger or sale, subject to Section 7 of the Privacy Policy.
